Epic Games Appeals to Supreme Court to Overturn Apple App Store Ruling

Epic Games is hoping to overturn a recent lower court ruling against Apple’s anti-steering rules with the help of the United States Supreme Court. Apple has petitioned the Supreme Court to review the 9th U.S. Circuit Court of Appeals’ decision, and Epic Games has submitted a request to lift the lower court’s decision.

The dispute began in 2020 when Epic Games updated their game Fortnite to allow players to avoid Apple’s payment system and pay Epic Games directly. Apple’s rules don’t permit companies to avoid the first-party payment system when paying through the App Store, and as a result Apple removed the game from the App Store. Epic Games responded by filing a lawsuit against Apple the same day they updated the game.

The original ruling regarding Apple’s anti-steering rules was issued in September 2021, and both companies appealed the decision. Apple has won nine of the ten claims so far, but the Supreme Court could potentially reverse the lower court’s ruling if it decides to hear the case. As of now, the Supreme Court is yet to move on this particular case.
